The Australian Greens look set to keep their balance of power in the Senate after holding on to their two seats in Victoria.



With just Queensland and NSW to be finalised, the Senate crossbench remains at eight members after the Victorian count confirmed Derryn Hinch was the only independent candidate to win a Senate seat in the state.



In Victoria, the Liberals won four Senators, the Nationals one, Labor four, the Greens two, which included leader Richard Di Natale, and Senator Hinch was the other.



With the Coalition on track to win 30 Senate seats, which is a loss of three, it needs nine other votes to pass legislation through the Senate. It will be able to do this with the support of Labor, which is on track for 26 seats, which is a gain of one, or the Greens,who are on track for nine, a loss of one.



The other option will be the crossbench, which is expected to grow by between one and three more Senators once Queensland and NSW are counted. Already confirmed on the crossbench are three Nick Xenophon Team Senators, two One Nation Senators, Senator Hinch, and Jacqui Lambie.



Treasurer Scott Morrison was in Adelaide on Wednesday talking to Nick Xenophon and his colleagues about passing budget measures.



Senior minister Christopher Pyne said everyone who has so far won a Senate spot was legitimately elected.



"The purpose of changing the voting laws was so that people would genuinely get elected because they got the vote as opposed to winning a lottery because they gamed the system and that has been achieved.



"So every Senator, whether they're major parties or whether they're minor parties or independents have now been elected because they actually got the requisite votes from the public. So democracy has been respected," he said.



He said the government still had a chance to pass the  bills re-establishing the Australian Building and Construction Commission and establishing a Registered Organisations Commission.
